I am completely aligned with you that we
should provide a safe environment in the workplace and be protected from dangers
presented from impairment. I do not agree, however, that violating our
constitutional rights under the guise of accomplishing these goals is
reasonable.
How To Pass A Drug Test At Home
- Studies show that the validity of drug
testing is surrounded by doubt. The American Medical Association, The Center for
Disease Control, The National Academy of Sciences and the National Institute of
Drug Abuse are among some of the groups who have done studies which have
determined the unreliability of drug testing. Urine testing is less accurate
than the lie detector tests that have been banned from the work place. Dr. David
Greenblatt, Chief of Clinical Pharmacology at the Tufts Medical Center, called
the most widely used drug tests "essentially worthless." An official for the
Center for Disease Control commented, "If these labs dumped the samples down the
sink or tossed a coin, they would have come up with the same reliability in
their test results."
If impairment or performance is a genuine
concern, drug testing does not test for that (not even remotely). Most accidents
are caused as a result of stress or sleep deprivation. A simple eye hand
coordination test would be the sensible solution.
Additionally, marijuana may remain
detectable for up to 90 days - - long after any possible impairment. Many
substances may cause a false positive to occur; thus causing those people who
have never done drugs to show up with a positive result.
Drug testing diverts energy and resources
from legitimate, productive programs that can actually help to decrease drug
use. Please refer to the book "Drug Testing - - a Bad Investment", based on
science from the National Academy of Sciences, it was determined that "Drug
testing fails to deliver on any of its promises. It is not a very effective
deterrent to drug use and is especially unlikely to deter people with serious
drug problems."
Drug testing also unfairly targets the
least dangerous of drugs, marijuana. Many who use marijuana on a periodic basis
are switching to "harder" drugs that don't last in the system as long. For
instance, after the Navy implemented drug testing, there was a "notable shift to
increased alcohol use," which correlates with increased accidents and decreased
productivity. LSD is said to have become the illicit drug of choice in the
military due to its relative undetectability. (Please see "Ur-ine Trouble - -

Failing.") It was shown that when England and Wales implemented the drug testing
of prisoners, use of marijuana decreased but the use of harder drugs, such as
heroin, almost doubled. (British Medical Journal 1996, June). You can do a line
of cocaine and pass a test immediately thereafter because it takes a while for
cocaine to metabolize and then when it finally does, it is only detectable on an
average of one to three days.
Drug testing divides families and destroys
trust. We should instead offer a scientifically grounded education that allows
people to learn all that they can about drugs, alcohol and any other
substance(s) they might ingest. The notion that we have the power to deter
people from experimentation with drugs is unrealistic. Many of us, including our
presidents and vice-presidents, mayors and governors have tried drugs. Many of
us have experienced "youthful indiscretions." Those who did, know that despite
recent fear-producing rhetoric, with moderate use, marijuana remains the most
benign substance on the drug scene, safer not only than cocaine and heroine but
alcohol, pharmaceuticals and certainly cigarettes. If marijuana use is defined
as risky, it becomes attractive rather than unattractive to people and in this
contest, its use is predictable. People know from their own experience and
observations that marijuana use does not inevitably lead to the use of harder

is given, they discount both the message and the messenger. (Please see - -

What can be said about the effects of drug
testing on the children? Parents lose their jobs due to faulty drug tests. Many
of these people become homeless, including the children. Many more children are
going to bed hungry at night due to lost income resulting from drug testing.
Children are being orphaned when their parents are imprisoned due to drug
testing. One and a half million children have a parent in jail or prison and
another three and a half million children have a parent on parole or probation.
It costs the taxpayers $20,000 a year per child for foster care. Children are
being taken from a parent in custody battles due to faulty testing. Often the
child is given to the abusive parent because the other parent tested positive
for marijuana, based on an inaccurate test. All of this is being done by a
government who prides itself on morals and claims to support "family values".
Drug testing policies are causing tremendous harm to families, society and

The major cause of death in this country
is from heart disease. Should we test for ice cream, hamburgers and french
fries? Many people have heart attacks while driving and are a risk to society.
Should we start testing for cholesterol levels? Just think how many lives we
could save if we outlawed high cholesterol.
Our government officials have taken an
oath of office to defend the Constitution. They are being paid with our tax
dollars to do that. I specifically call to your attention the Sixteenth American
Jurisprudence, Second Edition, Section 256. For your convenience, - - here it
is:
"The general misconception is that any
statute passed by legislators bearing the appearance of law constitutes the law
of the land, and any statute, to be valid, must be in agreement. IT IS
IMPOSSIBLE FOR BOTH THE CONSTITUTION AND A LAW VIOLATING IT TO BE VALID; ONE
MUST PREVAIL. This is strictly stated as follows:
The general rule is that an
UNCONSTITUTIONAL statute, though having the form and name of law, IS IN REALITY
NO LAW, but is wholly void and ineffective for any purpose; since
UNCONSTITUTIONALITY dates from the time of its enactment, and not merely from
the date of the decision so branding it. An UNCONSTITUTIONAL law, in legal
contemplation, is as inoperative as if it had never been passed. Such a statute
leaves the question that it purports to settle just as it would be had the
statute not been enacted.
Since an UNCONSTITUTIONAL law is void, the
general principles follow that it imposes no duties, confers no rights, creates
no office, bestows no power or authority on anyone, affords no protection and
justifies no acts performed under it.
A void act cannot be legally consistent
with a valid one. An UNCONSTITUTIONAL law cannot operate to supersede any
existing valid law of the land, it is superseded thereby.
NO ONE IS BOUND TO OBEY AN
UNCONSTITUTIONAL LAW AND NO COURTS ARE BOUND TO ENFORCE IT."
DRUG TESTING IS A VIOLATION OF OUR FOURTH
AMENDMENT "right of the people to be secure in their persons, houses, papers and
effects, against unreasonable searches and seizures." IT ALSO VIOLATES OUR FIFTH
AMENDMENT right not to be compelled "to be a witness against ourselves, nor be
deprived of life, liberty or property, without due process of law. It also
DENIES OUR FOURTEENTH AMENDMENT right to equal protection under the law.
