California Legislators Show Support for Treatment-vs-Incarceration

Last week two California legislative subcommittees sent a message of support for treatment when they rejected Governor Schwarzenegger's plans to slash funding for Prop. 36, the state's voter-enacted, treatment-instead-of-incarceration law . The law makes drug treatment available to tens of thousands of people convicted of nonviolent drug offenses each year, and in just six years, it has saved taxpayers more than $1.7 billion.
 
While the Assembly Budget Subcommittee voted to keep funding flat at $145 million, the Senate Budget Subcommittee voted to increase funding to $180 million. Passing Drug Test The subcommittee's recommendation to increase funding for  Prop. 36 suggests that legislators are heeding the advice of policy experts and treatment providers who say that more resources are needed.
 
In a study released in April, researchers from the University of California at Los Angeles showed that Prop. 36 needs a minimum level of funding of $228.6 million to provide adequate treatment and to generate greater cost savings. More funding translates into more treatment options, longer treatment durations and, if the money is spent in the right way, higher rates of success.
 
However, this year's budget battle is far from over. Because the funding levels recommended by the subcommittees are different, the question of Prop. 36 Passing Drug Test funding now heads to the Conference Committee, which is responsible for reconciling differences in the Senate and Assembly versions of the state budget. The Committee will probably make a final recommendation on Prop. 36 funding in June.
 
Once the full legislature approves the budget, it will go to the governor's desk. The governor, who has the power to reduce any item within the state budget (called "blue penciling"), will sign the budget in late summer or early fall.
 
Until then, DPA and other advocates will continue educating legislators and the governor on the importance and the success of Prop. 36.
